JUSTICE BIRENDRA KUMAR ORAL ORDER 09-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Section 364 of the Indian Penal Code.

Allegation is that the petitioners abducted the husband of the informant with intent to commit his murder. The husband of the informant in statement under Section 164 Cr.P.C. stated that he had taken loan from the petitioners and they were charging more interest and on non-payment of the same, the petitioners forcefully took him and committed assault. Submission is that abductions simplicitor is bailable one and no case of abduction for the purpose of murder is made

Considering the aforesaid facts, let petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada/Successor Court in connection with Hisua Police Station Case No. 23 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
