JUSTICE BIRENDRA KUMAR ORAL ORDER 25-02-2020 This application is for grant of leave to file appeal against the judgment of acquittal dated 10th of July, 2013 passed in Complaint Case No.643 of 1989 by Judicial Magistrate, 1st Class, Siwan, whereby Opposite Party No.1 to 3 were acquitted of the charges levelled against them.

I have carefully gone through the brief judgment recorded by the learned trial Judge wherein the learned trial Judge has discussed in detail that the so called forged document was found to be a genuine one by a competent civil court. Hence, a criminal court cannot look into that in absence of any evidence of the expert.

Therefore, I do not find any merit in this application

Patna High Court SLA No.59 of 2013(5) dt.25-02-2020 2/2 for special leave to file appeal against acquittal. Accordingly, it stands dismissed.
