The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
It is alleged that the articles of the informant were stolen by the petitioner who was travelling in the Auto rickshaw of the informant.
It is submitted by learned counsel for the petitioner only on suspicion the accusation has been levelled and informant has retracted from the initial version and filed a petition to that effect before the learned court below. A statement has been made in paragraph 3 of the petition that the
Patna High Court Cr.Misc. No.51348 of 2015 (2) dt.10-11-2015 2/2 petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Mahua P.S. Case No. 74 of 2015 pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur.
With the aforesaid observation, this application is disposed of.
