The petitioner seeks bail in Rohtas P.S. case No. 26 of 2017 under Section 414, 120B/34 of the Indian Penal Code. One truck loaded with turmeric was found standing by the side of the road. The petitioner along with Anup Choudhary @ Jitendra came near the truck. The petitioner and Anup Choudhary were apprehended and they are said to have disclosed that they, in collusion with Surendra Pal, driver of the truck, committed theft of truck loaded with turmeric. The learned counsel for the petitioner submits that similarly situated accused Anup Choudhary @ Jitendra has already been granted bail vide order dated 04.07.2017 passed in Cr. Misc. No. 18429 of 2017. The case of petitioner stands on the

Considering the facts that similarly situated accused Anup Choudhary has already been granted bail and the petitioner was also arrested with Anup Choudhary, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Dehri, Rohtas in Rohtas P.S. Case No. 26 of 2017.
