The present writ petition has been filed for quashing of the notification containing Memo No. 11367 (Bh) dated 18.12.2017 (Annexure-17) issued by the Joint Secretary, Building Construction Department, Bihar, Patna by which the punishment of withholding of two annual increments without cumulative effect has been awarded for the charge of delay in compliance of the order dated 13.08.2012 passed in CWJC No. 14524/2012.

3. Counsel for the State has raise preliminary objection and submits that petitioner has challenged the original order but not preferred the appeal.

4. In the light of the submissions made, this writ petition is disposed of directing the petitioner to avail remedy of statutory appeal before appellate authority within 30 dated from today.

5. It is hereby directed to condone the delay, if any, in filing the appeal and decide the appeal within 90 from the date of filing the appeal.
