The Petitioner apprehends his arrest in connection with Madhwapur P.S. Case No. 69 of 2016 registered for the offence punishable under Sections 406, 409, 420 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the school building for which the money has been allotted was being constructed when the F.I.R was lodged. It has further been submitted that a certificate has been issued by the District Programme Officer vide Memo No. 4301 dated 30.12.2016 which reflects that the construction of the building in question has been completed and there is no dues against the
Patna High Court Cr.Misc. No.22691 of 2017 (2) dt.01-06-2017 2/2 petitioner.
Considering the aforesaid facts and circumstances of the case, let the petitioner, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Benipatti, Madhubani in connection with Madhwapur P.S. Case No. 69 of 2016, G.R. No. 853/2016, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
