Misc. No.

Patna High Court Cr.Misc. No.49066 of 2016 (2) dt.16-12-2016 2/3 47481 of 2016. In the said case vide order dated 28.10.2016 while referring the matter to Mediation Centre of the Bihar State Legal Services Authority a Bench of this Court has directed not to take any coercive step against the petitioner. He submits that this petition which has been filed by father -in- law of the complainant may be heard together with the said case. This submission was made in presence of Sri Umesh Chandra Verma, learned counsel for the petitioner and Sri Harendra Prasad , learned Additional Public Prosecutor.

Heard Sri Umesh Chandra Verma, learned counsel for the petitioner , Sri Harendra Prasad, learned Additional Public Prosecutor and Sri Bimlesh Kumar Pandey, learned counsel for the complainant /opposite party no. 2.

The petitioner , apprehending his arrest in Complaint Case No. 1800-C of 2015 for the offence under Section 498-A of the Indian Penal Code has prayed for grant of bail. Learned counsel for the petitioner submits that petitioner is a retired Bank employee and husband of the complainant is also employed and he is maintaining his family independently .

Keeping in view the fact that in case of husband of the complainant there is already an interim order and the fact that

No.49066 of 2016 (2) dt.16-12-2016 3/3 petitioner is father -in- law and a retired employee, in the event of arrest or surrender within a period of six weeks from today, let the petitioner Bhudeo Sahani be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bettiah , West Champaran / concerned court in connection with Complaint Case No. 1800-C of 2015 subject to the conditions as contemplated under Section 438(2) of the Code of Criminal Procedure 1973.
