JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Petitioner is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 323 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.
The accusation is of making assault to the complainant, abusing by calling caste name and trying to throttle. The motive for the alleged occurrence has been alleged to be lodging of Bakhari P.S. Case No. 295 of 2014 filed by the complainant against the accused persons.
It is submitted by learned counsel for the petitioner that petitioner was not accused in the earlier case lodged by the complainant. Moreover for the occurrence of 11.10.2014 the complaint was filed on 13.10.2014. Considering the aforesaid facts, let the

No.51450 of 2015 (2) dt.10-11-2015 2/2 petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Begusarai in connection with Complaint Case No. 15181C of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
