The petitioner seeks bail in Bahadurpur P.S. Case No. 45/2017, registered for the offences punishable under Sections 400, 401, 413, 414, 420, 467, 468, 471, 120(B) and 34 of the Indian Penal Code.

The police got information that many persons are involved in selling of stolen vehicles. On such, Deepak Kumar was arrested and at his instance many stolen vehicles were recovered from the possession of different accused persons. On the disclosure made by Deepak Kumar one motorcycle bearing registration no. BR06AF7309 is said to have been recovered from the house of the petitioner.

Learned counsel for the petitioner submits that from

Patna High Court Cr.Misc. No.21351 of 2017 (3) dt.22-06-2017 perusal of the seizure list, it would appear that the motorcycle was recovered from the house of the petitioner, but in fact the motorcycle was recovered by the side of the road in front of the house of petitioner. The petitioner has got no criminal antecedent except one in which brother-in-law of the petitioner has lodged a case in retaliation of the case which was lodged by his sister against her husband under Section 498(A) of the Indian Penal Code. The petitioner is in jail since 05.02.2017. The petitioner has remained in jail for four and half months.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Darbhanga in connection with Bahadurpur P.S. Case No. 45/2017.
