The petitioner apprehends his arrest in connection with Saharsa (Sadar) P.S. Case No. 388 of 2019 for the offence punishable under Sections 379 and other allied sections of the Indian Penal Code.
The allegation is regarding the petitioner having tried to submit stolen demand draft by way of licence fee in the office of the informant, who is said to be the Mines Inspector. The learned counsel for the petitioners submits that the present case has been filed with oblique motive and illintention inasmuch as he had approached this Court by way of filing a writ petition bearing CWJC No. 6526 of 2017 and the Mining Department was directed to grant work order to the
Patna High Court CR. MISC. No.77752 of 2019(3) dt.09-12-2019 2/2 petitioner wherein it had also transpired that the informant of the present case was creating impediment. It is further submitted that the informant himself has been found to be involved in mal-practices and misconduct and has also been proceeded departmentally. Lastly it is submitted that the petitioner is innocent and is having a clean antecedent.
Having regard to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioners above named are directed to be released on anticipatory bail on furnishing bail- bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa (Sadar) P.S. Case No. 388 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) Tiwary/- U T
