JUSTICE RAKESH KUMAR ORAL ORDER 14-12-2016 Heard Sri Ashok Kumar Singh, learned counsel, who was assisted by Sri Suresh Prasad Bhakta, learned counsel for the petitioner, Sri Nityanand, learned Addl. Public Prosecutor as well as Sri S.K.Lal, learned counsel, who has voluntarily appeared on behalf of the informant.
The sole petitioner, apprehending his arrest in Sheikhpura P.S. Case No.145/2016 registered for the offence under Sections 147, 148, 149, 448, 341, 323, 324, 325, 307, 354, 379 of the Indian Penal Code and Section 27 of the Arms Act, has prayed for grant of bail, primarily on the ground that one of the accused , namely, Kaleshwar Yadav @ Kale Yadav has been granted privilege of anticipatory bail by order dated 20.09.2016 passed in Cr.Misc.No.35471 of 2016, However, after noticing the
Patna High Court Cr.Misc. No.49053 of 2016 (2) dt.14-12-2016 2/2 view that the Court was not inclined to extend the privilege of anticipatory bail to the petitioner, learned counsel for the petitioner makes a prayer for disposal of the present case, so that the petitioner may appear before the court below and make a prayer for regular bail.
The prayer is allowed.
The petition stands disposed of with indication that if within six weeks from today the petitioner appears before the court below and makes a prayer for regular, the learned court below may examine the same and pass appropriate order keeping in its mind that one of the accused almost on similar accusation has been extended the privilege of anticipatory bail, The bail order may be passed preferably on the same day.
