Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Jiradai P.S. Case No. 62 of 2022 lodged under Sections 302, 120B/ 34 of the I.P.C. read with Section 27 Arms Act. As per the prosecution case, the allegation has been made by the informant against 2 accused persons, namely, Raman Singh and Anurag Kumar Singh from whom there is direct conflict relating to land and threatening was continuously given from their side in the F.I.R. It is the petitioner who was

Patna High Court CR. MISC. No.62211 of 2022(2) dt.25-02-2023 2/3 with the informant at the time of occurrence and it is he who has informed about this occurrence to the informant. But informant instead of 2 persons with whom dispute is there, has also made present petitioner as accused in the F.I.R.

Learned counsel for the petitioner submits that the informant is not the eye witness. He has lodged the F.I.R. by virtue of the statement of the petitioner itself. He further submits that the antecedent of the petitioner is clean and he is in custody since 23.07.2022. Counsel further submits that in the F.I.R. the specific allegation is against Raman Singh and Anurag Kumar Singh with whom there were land dispute. The name of petitioner has come on suspicion.

Learned counsel for the State opposes the prayer for bail.

Learned counsel for the informant vehemently opposes the prayer for bail and submits that informant has still strong suspicion against this petitioner and his involvement in this crime must not be ruled out.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to

The Trial Court is directed to expedite the trial as early as possible.

With this observation, the bail application stands allowed.
