ANJANA MISHRA ORAL ORDER 22-01-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Baikunthpur P.S. Case No. 143 of 2013, registered for offences punishable under Sections 147 & 304 of the Indian Penal Code.
Learned counsel for the petitioners submits that allegation against the petitioners is that, they along with some other co-villagers indulged in the mass killing leading to death of one person who is said to have entered into the house of one Bikarma Sahni for committing theft. It is submitted on behalf of the petitioners that they are not one of the family members of the Bikarma Sahni and they are one of those villagers who on hulla had assembled at the place. Patna High Court Cr.Misc. No.51657 of 2015 (4) dt.22-01-2016 2/2 villagers leveled with similar allegations, have been extended the privilege of anticipatory bail in Criminal Miscellaneous No. 6406 of 2014 vide order dated 22.04.2014.
Considering the aforementioned facts and circumstances and also the fact that the petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj at Gopalganj in connection with Baikunthpur (Gopalganj) P.S. Case No. 143 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
