The petitioner seeks bail in a case registered under Section 302 of the Indian Penal Code.
Earlier prayer for bail of the petitioner was rejected by this court vide Annexure-1 to this application with an observation "At this stage". Hence the present application has been filed.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 11-04-2018. Charge sheet has already been submitted. A brick-bat is said to have taken place
Patna High Court CR. MISC. No.58157 of 2019(3) dt.18-12-2019 2/2 in course of the occurrence which led to the death of the deceased. The petitioner had no knowledge nor any intention to commit the murder of the deceased, At best, it is a case for offence under Section 304-II of the Indian Penal Code. The petitioner undertakes to cooperate during trial. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the period of custody, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 189 of 2018.
