The present writ petition has been preferred for the following relief/s:- "1) That, this is an application for issuance of appropriate writ or writs, direction or directions commanding the respondents for a direction to the respondents particularly the resp.no.4 to measure the land of the petitioner which was purchased by the petitioner through the registered sale deed dated 16.12.2010 and in spite of deposit of measurement cost and in spite of notice thrice to the petitioner for measurement but the measurement was not done by the resp. no.4 till date and or issuance of consequential writ or writs under the facts and circumstances of the case."

Learned counsel for the petitioner submits that on 08-04-2021, petitioner has filed an application before the Circle Officer, Banka (respondent No.4) for measurement of his purchased land vide sale deed dated 16-12-2010 (Annexure-P/1 series) and has deposited the cost of measurement of Rs. 1500/- in Nazarat of the Anchal, having its receipt No. 644344. 4.

On receipt of such application, respondent No.4 directed the Revenue Karamachari to inquire into the matter and

3/4 submit a report. Report (Annexure- P/3) was submitted on 25-06-2021, stating that since private respondents used to make dispute over the land in question, as such the petitioner wants to get measurement of his land and accordingly, recommendation was made for measurement of the said land as per boundary of the said land.

It is the contention of the learned counsel for the petitioner that from the Office of respondent No.4, notices were thrice issued for measurement of the land in question i.e., dated 29-07-2021, 25-02-2022 & 05-04-2022, respectively, but till date no measurement is being done on the land in question. Thus, learned counsel for the petitioner seeks a direction of this Court for measurement of his land in question within a time frame.

On the other hand, learned counsel for the State does not object to the submissions canvassed on behalf of learned counsel for the petitioner.

Having considered the facts and circumstances of this case, this Court deems it apposite to issue a direction upon the Circle Officer, Banka (respondent No.4) to measure the land of the petitioner, in accordance with law, within a period of eight weeks from the date of receipt/production of a copy of this
