The petitioner wants to renew the prayer of bail, which was earlier rejected by order dated 29.06.2016 passed in Cri. Misc. No. 18418 of 2016 on the ground that the petitioner is in custody since 26.10.2015, the confessional statement recorded by the police has got no evidentiary value in the eye of law, he is not named in the First Information Report, the other co-accused namely Bablu Chaudhary has been allowed bail by different coordinate Bench of this Court and, as such, the petitioner also deserves sympathetic consideration, to which, learned A.P.P. opposes by submitting that the petitioner has confessed his guilt leading to recovery of firearm hidden in the bush and further the
Patna High Court Cr.Misc. No.50124 of 2016 (2) dt.30-11-2016 2/2 petitioner has got criminal antecedent also.
In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again the prayer of the bail of the petitioner stands rejected. However, considering the detention of the petitioner, let the trial be expedited and concluded as early as possible preferably within 9 months from the date of receipt/production of a copy of this order.
