We have also heard Mr. Ramakant Sharma, learned Senior Counsel, appearing for the respondent No.8.

After some arguments, Mr. S. B. K. Mangalam, learned Counsel, appearing for the appellant, seeks permission to withdraw this appeal with liberty to challenge, in accordance with law, the notice, dated 04.11.2015 (Annexure-1 to I. A. No. 9118 of 2015), which has been issued by the respondent No. 6, Block Development Officer-cum- Executive Officer, Block Panchayat

Patna High Court LPA No.2069 of 2015 (2) dt.10-11-2015 2/2 Samiti, Bihta, whereby a special meting to discuss the motion of no confidence against the appellant, Pramukh of Block Panchayat Samiti, Bihta, has been convened on 14.11.2015 at 12 Noon. No objection has been raised by the respondents to the prayer for withdrawal made by the petitioner. In view of the above and in the interest of justice, this appeal is hereby disposed of as withdrawn with liberty granted to the appellant to challenge, in accordance with law, the notice, dated 04.11.2015 (Annexure-1 to I. A. No. 9118 of 2015), which has been issued by the respondent No. 6, Block Development Officer-cum- Executive Officer, Block Panchayat Samiti, Bihta, whereby a special meting to discuss the motion of no confidence against the appellant, Pramukh of Block Panchayat Samiti, Bihta, has been convened on 14.11.2015 at 12 Noon.
