On 31.08.2016, Drug Inspector, Jainagar had filed written report disclosing therein that he has been telephoned by the police official with regard to seizure of drugs carrying remark Bihar Government supply not for supply/sale. Furthermore, the accused have also narrated that same was provided by Raghubir Bhagat, retired clerk of DMCH.
It is apparent from the case diary that petitioner along with Santosh Kumar Sah were arrested on 30.08.2016 by a constable from Train No.53041 along with a cartoon. Furthermore, from seizure list, it is evident that recovery has been shown from both accused. When seizure list was prepared on 30.08.2016 then in that event filing of instant written report on 31.08.2016 has got bearing and in the aforesaid background along with period of custody as well as absence of criminal antecedent, petitioner Raj Kumar Gupta is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned
