2. The petitioners seek bail in a case registered for the offence punishable under Sections 103(1), 3(5) of the BNS, 2023.
3. Prosecution case in brief is that on 09.05.2025 at 7.00 AM, these petitioners took the younger son of informant Md.Bildar Khan near Munsi Mosque for inquiry of PAN card and Aadhar Card in pickup vehicle in presence of the informant. After 2-3 hours, Sakil Shah told the informant that petitioner no. 1, Budha Yadav and 4-5 unknown persons have tied her son in Neem tree and are assaulting him. Informant rushed there and
Patna High Court CR. MISC. No.67755 of 2025(2) dt.12-11-2025 2/2 found her son lying unconscious. Her son told her that petitioner no. 1, Budha Yadav and 4-5 unknown persons have assaulted him and he died immediately.
4. Petitioners have been falsely implicated in this case due to previous enmity. Petitioners are in custody since 13.05.2025 and 10.05.2025 respectively and petitioner no. 2 claims clean antecedent.
5. Learned APP however, vehemently opposes the prayer for bail.
6. Considering the facts aforesaid and nature of accusation, I am not inclined to enlarge the petitioners abovenamed on bail in connection with Naya Bhojpur PS Case No. 53 of 2025, pending in the Court of learned Chief Judicial Magistrate, Buxar. Accordingly, the same is rejected.
7. However, as the petitioners are in custody since 13.05.2025 and 10.05.2025 respectively, the trial Court is directed to expedite and conclude the trial preferably within a period of one year from the date of receipt/production of a copy of this order.
