Petitioner apprehends arrest in connection with Alauli Police Station Case No 166 of 2015 registered for the offences punishable under Sections 366A, 376, 120B/34 of Indian Penal Code.
It has been submitted on behalf of the petitioner that the main accused Mangnu Kumar, who is alleged to have kidnapped the victim girl, has been acquitted on 19.04.2016 vide SC No 275 of 2015 by the Court of learned Additional Sessions Judge I, Khagaria. So, there remains nothing against the petitioner being mother of the said Mangnu Kumar. The judgment and order of acquittal is annexed as Annexure 2 to the instant petition.
Patna High Court Cr.Misc. No.24317 of 2017 (2) dt.31-05-2017 2/2 Considering the aforesaid facts and circumstances, the petitioner, on her arrest or surrender within four weeks from today, shall be released on bail on her furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in Alauli PS Case No 166 of 2015 arising out of GR No 1827 of 2015 subject to all conditions as laid down in Section 438
(2) of Criminal Procedure Code.
