Petitioner seeks bail in a case registered for the offence punishable under Sections 363, 366, 376 and 379 of the Indian Penal Code.
In the statement victim lady has stated that she along with her baby child of three years was enticed by the petitioner to go to Nepal. The petitioner took away Rs. 50,000/- out of 60,000/- of her money and thereafter left her. Submission is that in fact, the victim had gone voluntarily with the petitioner and petitioner has falsely been implicated in this case under pressure of parents. Petitioner is in custody since 11.06.2019.
Considering the facts aforesaid, let the petitioner,
Patna High Court CR. MISC. No.59663 of 2019(2) dt.27-09-2019 2/2 above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Benipatti P.S Case No. 16 of 2014, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
