The husband of the petitioner died while in service on 06.03.2017.

The petitioner is claiming appointment on compassionate ground, being second wife of the deceased by submitting that the first wife is no more and she is the only surviving wife of the deceased.

Learned counsel for the Bank has filed a counteraffidavit. It is the specific averment of the Bank that the petitioner has not filed application in the prescribed format. The Bank is gracious enough to place on record the format which petitioner is required to fill up. The same is Annexure-B to the counter-affidavit.

The rejoinder reveals that the petitioner has been representing to the Bank since 2017 for the benefit of compassionate appointment.

Since the petitioner has made her claim, but not in the prescribed performa/format, the benefit has remained elusive till date, as per pleadings on record. Therefore, no adjudication is called for in the instant proceedings.

If the petitioner makes her application in the prescribed format within 4 (four) weeks, the Bank would be obliged to consider the same in accordance with law within 8 (eight) weeks thereafter by a reasoned and speaking order. Application is disposed of.
