The petitioners seek bail in a case instituted under Section 47(A) of Excise Act and Section 147 of the Railway Act. The allegation against the petitioners is that total 81 liters of foreign wine are said to have been recovered from their joint possession.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 19.08.2016. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Gaya in connection with Rail Gaya P.S. Case No. 219 of 2016.
