JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 15-12-2015 Heard counsel for the petitioner and the State. The petitioner is an accused of Singheshwar P.S. Case No. 110 of 2015 instituted under section 414 IPC and sections 25(1-B) A, 26(ii) and 35 of the Arms Act. The informant is the Police Officer who has alleged that the person of the petitioner was searched and one country-made pistol and two live cartridges were recovered. The petitioner failed to give any explanation or to produce any licence.
It is stated that the petitioner is in custody since 07.07.2015 having no criminal antecedent.
In the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail
Patna High Court Cr.Misc. No.52159 of 2015 (2) dt.15-12-2015 2/2 bond of Rs. 10,000/-with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Madhepura in Singheshwar P.S. Case No. 110 of 2015 on condition that one of the bailors shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall cancel his bail bonds.
