Patna High Court Cr.Misc. No.48865 of 2015 (2) dt.09-11-2015 2/2 case, they are being heard and disposed of with this common order.
Petitioners apprehend their arrest in a case under section 307 and other allied sections of the Penal Code on the allegation that they and other villagers abused the police party by pelting bricks on them and setting on fire the police jeep. The petitioners submit that in fact villagers were protesting against the incident in which miscreants had fired at one Bhupendra Kumar and robbed him. Further, the specific allegation of setting fire to police jeep is against accused Surendra Paswan and similarly situated other co-accused have already been allowed anticipator bail by this Court. In the facts of the case, in the event of arrest/surrender, let all the 14 petitioners as mentioned above be released on bail on furnishing bail bond of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad, in Barun Police station Case No. 119 of 2014.
