JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2017 The petitioners are in custody since 01.01.2017 in connection with Maner P.S. Case No. 591 of 2016, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act and Section 25(1-B) and 26 of the Arms Act.

Allegation is of recovery of 450 litres of mahua liquor. It has been submitted on behalf of the petitioners that petitioners have no concern with the alleged recovery and no where concerned with the boat from which the recovery has been made. Moreover, the petitioners have sufficiently been punished as they have remained in judicial custody for about six months. Heard learned A.P.P. also.

Having heard both sides, considering the facts and

No.21910 of 2017 (3) dt.21-05-2017 2/2 circumstances of the case, nature of allegation, period of custody and also that petitioners have no criminal antecedents, as such, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sri Randhi Kumar, Judicial Magistrate- 1st Class, Danapur, in connection with Maner P.S. Case No. 591/2016. It is made clear if the petitioners again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of their bail bonds.
