JUSTICE BIRENDRA KUMAR ORAL ORDER 09-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 326, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. On the order of this petitioner, co-accused Shiv Shankar Rai fired causing injury to the informant. Submission is that the petitioner is simply an order giver as alleged and co-accused, namely, Gopal Rai has already been allowed anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 32928 of 2016 on 18.10.2016. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt

Patna High Court Cr.Misc. No.49863 of 2016 (2) dt.09-12-2016 of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/Successor Court in connection with Hajipur Town Police Station Case No. 378 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
