The petitioner is apprehending her arrest in a case registered for the offence punishable under Sections 381/34 of the Indian Penal Code.

The prosecution case is that the informant has alleged that informant Rahbar Abdin had kept the accused petitioner Rekha Devi as maid servant at his house who used to look after his mother-in-law Sandhya Sinha. It is further alleged that after the death of Sandhya Sinha, the accused petitioner had stolen away all the ornaments of about Rs. 15 lacs of Sandhya Sinha and the same has been deposited in Muthoot Finance in the name of the father, brother and other family members of accused petitioner and she took loan from the said Muthoot

Learned counsel for the petitioner submits that the allegation as alleged in the F.I.R. is totally false and wrong. He has stated that the petitioner has no concern with the alleged gold and no any loan has been taken on the said gold from Muthoot Finance. He submits that petitioner has no criminal antecedent and she has been falsely implicated on suspicion. He further submits that there is no independent witness to support the prosecution story in the case diary.

In the facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XVI, Patna in connection with Budha Colony Police Station Case No. 315 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
