The petitioner seeks bail in a case registered for the offence under Section 307 and other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, on the alleged date of occurrence, this petitioner alongwith other accused persons entered in the house of informant and thereafter, abused and assaulted wife of informant and caused injury to her due to giving evidence against this petitioner and other accused persons in court.

It is submitted on behalf of petitioner that there is general and omnibus allegation and injury sustained by wife of informant has been found to be simple in nature by the doctor. Petitioner is in custody since 03.08.2021.

No.1237 of 2022(3) dt.26-04-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific allegation against this petitioner of assaulting the wife of informant as well as petitioner has got criminal antecedent and he is accused in five more cases.

Considering the aforesaid facts and circumstances as well as criminal antecedent of petitioner, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected. (Prabhat Kumar Singh, J) anay/- U T
