After hearing the parties, the Court does not find any infirmity in the order passed by the court below. However, the order is modified to the extent of imposition of cost of Rs.1000/-, as the application was moved in bonafide and there was no malafide intention of the petitioners. Considering the aforesaid, the order as contained in Annexure-4 is modified that the court below will not execute cost imposed on the petitioners and the other part of the order shall remain intact.
