The petitioner apprehends his arrest in Barauni (Zero Mile) P.S. Case No. 335/2016, registered for the offences punishable under Section 47(A) of the Excise Act. It appears that two bottles of Indian made foreign liquor was recovered from the dickey of motorcycle bearing registration no. BR09J-4980. Petitioner is said to have fled away leaving motorcycle on the way.

Learned counsel for the petitioner submits that the petitioner was not driving the motorcycle and he had not left the motorcycle on road.

It appears that only two bottles of Indian made foreign liquor was recovered.

No.49187 of 2016 (2) dt.16-12-2016 2/2 Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni (Zero Mile) P.S. Case No. 335/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
