2. The petitioner in this application prays for grant of anticipatory bail apprehending his arrest in connection with Excise P.S. Case no. 838 of 2025 registered for the offence punishable under sections 30(a), 33 and 34 of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, on a raid being conducted 160.125 litres of liquor was recovered from the house of one Lal Babu Sahni. It is further stated that as per secret information the petitioner was involved in trade of liquor.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. No incriminating article was recovered from petitioner's possession. He has no concern with the house of Lal Babu Sahni
Patna High Court CR. MISC. No.62709 of 2025(2) dt.24-09-2025 2/2 and is not related to him. He undertakes to cooperate in the investigation/trial.
5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegation in the F.I.R., no incriminating article having been recovered from the petitioner's possession and the petitioner not having any concern with the house or with Lal Babu Sahni, it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Excise P.S. Case no. 838 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court no.- II, Muzaffarpur.
