====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 10-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. In the present case, the petitioner seeks bail in connection with Karakat P.S. Case No. 274 of 2025, registered for the offences under Sections 25(1-b)(1), 26, 35 of the Arms Act.

3. As per the prosecution case, police received secret information about petitioner bringing illegal firearm in his house and a raid was conducted and a recovery of Rs.3,97,600/- cash was made. Petitioner was found running away from the house, he was apprehended. From the bag being carried by the petitioner, a country made pistol with two magazine and eleven cartridges were recovered apart from pen drive and mobile phone. 4. Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case and he is innocent. The recovery of cash could be explained by the fact that petitioner and his brothers are in business and their turn over is Rs.13-15 lakh per month. The said money was seized by the police. The petitioner has no knowledge about recovery shown of firearms and other articles and the said articles are planted by the police at the instance of some persons who are at inimical terms with the family of the petitioner. The petitioner is in custody since 25.05.2025 and charge sheet has been submitted. The petitioner is having antecedent of one case.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned A.P.P. submits that the petitioner was caught red handed with country made pistol and magazines.

6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the submission of charge sheet and period of custody of the petitioner, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand

No.62023 of 2025(2) dt.10-09-2025 3/3 Only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bikramganj, Rohtas/concerned court, in connection with Karakat P.S. Case No. 274 of 2025, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
