The petitioner, who is in custody in connection with Jhajha G.R.P.S. Case No. 50 of 2015, registered for the offence punishable under Section 307 and other allied Sections of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that in identical situation one of the co- accused Balkrishna Gupta @ Sagar Gupta has been granted bail by this court on 3.9.2015 vide Cr. Misc. No. 40798 of 2015. He further submits that in the F.I.R. itself there was general and omnibus allegation against the accused persons.
Learned A.P.P. has opposed the prayer for bail. He submits that a Police Officer was assaulted by the accused
Patna High Court Cr.Misc. No.52118 of 2015 (2) dt.02-12-2015 2/2 persons.
Be that as it may, since one of the co -accused almost in similar situation has been extended the privilege of bail, there is no reason to deny the prayer for bail to the petitioner. Let the petitioner Rajeeb Ranjan Gupta be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul (Lakhisarai) in connection with Jhajha G.R.P.S.
