The petitioner, being husband of the complainant, is languishing in custody since 25.7.2019 in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the I.P.C. and Section 4 of Dowry Prohibition Act. The prosecution case is that the marriage of the petitioner was solemnized with the complainant in 2008 but subsequently dowry demand of Rupees Five Lacs was made and due to nonfulfillment of the same, torture was inflicted upon the complainant by the petitioner and other in-law family members. It is submitted by learned counsel for the petitioner that

Patna High Court CR. MISC. No.62381 of 2019(2) dt.22-10-2019 2/2 false accusation has been levelled against the petitioner. Learned APP submits that the specific accusation of demand of dowry and subsequent torture are against the petitioner.

Considering the nature of accusation and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Banka in connection with Complaint Case No. 493 of 2017.
