Mr.Pawan Kumar Chaurasia, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 01-10-2024 Heard Mr. Sarvottam Kumar, learned counsel appearing on behalf of the petitioners and Mr. Pawan Kumar Chaurasia, learned APP for the State.

2. Petitioners seek regular bail in connection with Beerpur P.S. Case No. 68 of 2024 registered for the offences punishable under Sections 341, 323, 504, 325, 307 and 379 of the Indian Penal Code.

3. As per the allegation made in the FIR, all the accused persons named therein had abused and assaulted the two daughters of the informant and had snatched gold chain from the neck of her daughter, Khushbu Devi.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.66432 of 2024(2) dt.01-10-2024 2/3 petitioners submitted that there is case and counter case. Both the parties are Gotia and for trivial reason, they indulged into fierce fight, and in course of same, the petitioners in their selfdefence might have caused some injury on the person of the informant's daughter. Petitioners have clean antecedents.

5. Learned APP appearing for the State opposes the bail prayer.

Having considered the rival submissions made on behalf of the parties, as well as, the fact that both the parties are agnates and there is case and counter case between them and due to trivial issue, they indulged into fierce fight and in their self-defence, the petitioners might have caused some injury on the persons of the informant's two daughters, the learned District Court is directed to release the petitioners, above named, on bail upon furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand)each with two sureties of the like amount each to the satisfaction of learned J.M.1st-cum-A.M., Begusarai in connection with Beerpur P.S. Case No. 68 of 2024 subject to the following conditions:

(i) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.

Patna High Court CR. MISC. No.66432 of 2024(2) dt.01-10-2024 3/3 (ii) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court. (iii) If the petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners. (iv) If the petitioners are found involved in similar nature of offence, after their release on bail, the trial Court shall take steps to cancel their bail bond.

(v) The learned District Court is directed to verify the criminal antecedent of the petitioners as stated in paragraph no. 3 of the bail application. If any other case is pending against the petitioners as what has been stated in paragraph no. 3, this order will lose its force automatically.
