The petitioner apprehends his arrest in Sultanganj P.S. Case No. 194/2015, registered for the offences punishable under Sections 494, 354, 366, 376 and 34 of the Indian Penal Code.

The informant made allegation that the petitioner took her and kept her for two months. The victim became pregnant. The informant further alleged that Ashok Mandal and other accused persons forcibly took her to somewhere else and forced her to marry with Mantu Singh.

Learned counsel for the petitioner submits that the victim made her statement under Section 164 of the Cr.P.C. She

Patna High Court Cr.Misc. No.23861 of 2017 (2) dt.14-07-2017 2/2 categorically disclosed that her father married her in Belhar Sangrampur. The victim is a major girl.

It appears that the victim voluntarily on persuasion of the petitioner left her house. The petitioner made physical relation with the victim and forced her to marry with Mantu Singh. The victim was pregnant on account of having physical relation with the petitioner.

Considering the nature of allegations made against the petitioner, I am not inclined to enlarge the petitioner, above named, on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) Rakhi U T
