The present petition has been filed for grant of regular bail on behalf of the petitioner in connection with Dhanarua P.S. Case No. 178 of 2019 registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b), 26 and 35 of the Arms Act.

The allegation is regarding the accused persons having hatched a plan to commit robbery at a jewelry shop, however, upon secret information having been received by the Police, they had started searching vehicles and during the said search, the accused persons were apprehended and some arms and other articles were recovered from them, however, as far as

Patna High Court CR. MISC. No.60821 of 2019(3) dt.20-11-2019 2/2 the petitioner is concerned, only one Samsung mobile is said to have been recovered.

The learned counsel for the petitioner submits that the petitioner has a better case than the co-accused persons, who have already been granted regular bail vide orders dated 22.10.2019 and 06.11.2019 passed by a coordinate Bench of this Court in Criminal Misc. No. 63677 of 2019 and Criminal Misc. No. 68663 of 2019. It is further submitted that the petitioner is languishing in custody since 08.05.2019.

Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioner, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand), with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Masaurhi, District-Patna in connection with Dhanarua P.S. Case No. 178 of 2019.
