01-12-2015 Heard Dr. Sanjay Kumar Singh, learned counsel for the petitioner and Sri Damodar Pd. Tiwary, learned Addl. Public Prosecutor.

The petitioner, who is in custody in Bihariganj P.S. Case No. 36 of 2014 registered for the offence under Sections 147, 148, 149, 341, 323, 324, 379 & 506 of the Indian Penal Code and subsequently section 307 of the I.P.C. was added, has prayed for grant of bail.

Learned counsel for the petitioner submits that in this case, almost all the other accused persons have been extended the privilege of anticipatory bail. He further submits that the petitioner had also approached for grant of anticipatory bail, but keeping in view the fact that the petitioner had given blow by the

Patna High Court Cr.Misc. No.52024 of 2015 (2) dt.01-12-2015 2/2 iron rod, his prayer for anticipatory bail was rejected. It has been argued that in a spur of moment, the occurrence had taken place. There was no intention.

Keeping in view the nature of accusation as well as the fact that number of accused persons have been extended the privilege of anticipatory bail and the petitioner is in custody, let the petitioner namely Mansur Ansari alias Md. Mansur alias Md. Mansur Ansari be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Pradeep Kumar Chaudhary, learned Judicial Magistrate 1st Class, Uda Kishunganj, Madhepura/concerned court in connection with Bihariganj P.S. Case No. 36 of 2014.
