JUSTICE BIRENDRA KUMAR ORAL ORDER 17-02-2017 Heard the learned counsel for the petitioner and the State.

This is a petition for grant of anticipatory bail for offences under Sections 366 and 379 of the Indian Penal Code. The wife of the informant, along with her three children, was missing from the rented house where she was living. Getting the information, the informant came back to India and lodged a case against the petitioner as the petitioner was suspected to induce her to go with him. The land lord of the victim sated that the victim along with her children had gone along with an unknown person was introduced him as her husband. That person disclosed his name as petitioner, Md. Afsar Ali. In view of the above material, apparently the petitioner has not committed any offence for the purpose of his bail.

Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with

Patna High Court Cr.Misc. No.49851 of 2016 (3) dt.17-02-2017 2/2 Jehanabad P.S. Case No. 290 of 2016 to the satisfaction of the Chief Judicial Magistrate, Jehanabad, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
