JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-06-2017 Heard learned counsel for the petitioner and learned APP representing the State.

Petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case No. 319 of 2016 registered for the offences punishable under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code.

Allegedly, the petitioner and co-accused started abusing the informant and at the instigation of Raj Nandan Singh the petitioner started assaulting him and gave rod blow on his head causing injury and further snatched Rs. 6,000/- and chain of the informant was snatched by co-accused Anil Kumar. Submission is of false implication and that the injury caused to the informant is simple in nature, no offence under Section 307 IPC is made out as there is no allegation of repeating the blow, other two co-accused have been allowed pre-arrest bail

Patna High Court Cr.Misc. No.22068 of 2017 (2) dt.19-06-2017 by the learned court below and as such the petitioner also deserves sympathetic consideration.

Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, considering the injury of the informant, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bar hic, Bakhtiyarpur P.S. Case No. 319 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
