The petitioner is in custody since 15.04.2019 in connection with Biraul P.S. Case No. 60 of 2019 for the offence registered under Sections 328, 364, 382, 401/34 and 120(B) of the Indian Penal Code.
Learned counsel for the petitioner submits that the name of the petitioner transpired on the basis of the confessional statement made by co-accused Roshan Kumar, who has said that the leader of the gang is Vishal Kumar. It is further submitted that no incriminating article has been recovered from the possession of the petitioner. It is further submitted that the petitioner has not been placed on T.I. Parade till date. It is further submitted that only on the basis of the confessional

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Biraul, Darbhanga in connection with Biraul P.S. Case No. 60 of 2019.
