The present writ petition has been filed for the issuance of a writ in the nature of mandamus commanding the respondent authorities to consider the representation, filed by the petitioner on the post of Agriculture Coordinator under reserve seat of BC II female category and after considering the representation to appoint the petitioner on the post of Agriculture Coordinator in her reserved seat of BC II female category, not under General category.

3. The stand of the Commission is that on the date of

Patna High Court CWJC No.2391 of 2018(3) dt.18-09-2023 2/2 counselling, 18.01.2016, the petitioner failed to submit Non Creamy Layer certificate and as such, she was put under the General category and thus cannot claim relief.

4. It is the case of the learned Counsel for the petitioner that though the said fact has been incorporated in the counter affidavit, the concerned document showing non submission of NCL certificate has not been annexed.

5. She as such, submits that the petitioner will file fresh representation before the concerned respondent.

6. If such fresh representation is filed, the respondents may dispose it of.

7. It is made clear that this Court has not expressed any opinion in the matter.

8. The writ petition stands disposed of.

9. Before parting, this Court would like to put on record its word of appreciation for Ms. Ankita Roy, learned counsel for the petitioner for the proper assistance rendered in the matter.
