JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-01-2023 Learned counsel for the petitioners seeks permission to withdraw the application of petitioner nos. 3 and 4 namely Sikandra Bind and Mantu Bind @ Vivek Kumar respectively. Permission is accorded.
Accordingly, the application of petitioner nos. 3 and 4 namely Sikandra Bind and Mantu Bind @ Vivek Kumar is dismissed as withdrawn.

The petitioner nos. 1, 2 and 5 apprehend their arrest in connection with Rahui P.S. Case No. 368 of 2022 registered under Sections 147, 148, 149, 341, 379, 386 and 389 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case on account of land dispute. Further submission is that the land in question has already been settled by the government in the favour of the petitioners through Land Settlement Case No. 01 of 2015-16 vide Memo Nos. 415, 416, 417 and 423 dated 13.05.2017 and the rent receipts have also been issued in favour of petitioners, as contained in Annexure-2 series to the bail petition. He also submits that petitioners have got no criminal antecedent. Having considered the facts and circumstances of the case, let the petitioner nos. 1, 2 and 5 namely Jatan Bind @ Ram Jatan Bind, Chandeshwar Bind and Santu Bind be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional Chief Judicial Magistrate-I, Nalanda at Biharsharif in connection with Rahui
