The petitioner has prayed for bail in connection with Hajipur Town P.S. Case No. 336 of 2020 instituted for the offence under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 25(1)(a), 26, 29(b), 30 and 35 of the Arms Act.

Prosecution case in short is that on the alleged date of occurrence, informant got that one Chandan Singh(Petitioner) has come to his house to which the informant along with other police officials proceeded to the house of petitioner. It is alleged that he succeeded in fleeing away but three co-accused persons were arrested. A country

Patna High Court CR. MISC. No.62254 of 2022(3) dt.02-03-2023 2/3 made pistol and one live cartridge of 0.315 bore was recovered from the possession of Amardeep @ Phoolan, Amarnath Singh and Rana Singh. Police has recovered arms and ammunitions along with other articles in huge quantity from the house of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this present case. The petitioner has no concern with the alleged occurrence and seized illegal arms. He was not arrested on spot. Petitioner is languishing in custody since 23.05.2022.

Learned APP appearing for the state has vehemently opposed the prayer of regular bail and submitted that the petitioner has 15 criminal antecedents and from perusal of the seizure list, there are recovery of 37 seized items from the house of the petitioner in which, five country made pistols, one revolver, one rifle, live cartridges in huge quantity of different bore, and also magazines in huge quantity , laptop, several mobiles phones of different brands and some other illegal weapon's parts.

Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for

The trial court is directed to expedite the trial and conclude the same as soon as possible.
