2. The petitioner seeks bail in connection with Baniyapur P.S. Case No. 305 of 2021 registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. Learned counsel for the petitioner submits that the petitioner is in custody since 04.08.2023 and there is recovery of 480 litres of foreign liquor from possession of the petitioner. He further submits that petitioner is ready to donate Rs. 25,000/- (Rupees Twenty Five Thousand Only) in some charitable organization.

4. Learned APP has vehemently opposed the prayer of bail.

5. Considering the period of custody and recovery of illicit liquor, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-cum-Exclusive Special Excise Judge-I, Saran at Chapra in connection with Baniyapur P.S. Case No. 305 of 2021.

7. Petitioner's bail bond shall be accepted only after he deposits Rs. 25,000/- (Rupees Twenty Five Thousand Only) in Ram Krishna Mission, opposite circuit House, Saran at Chapra, Bihar and produces the receipt of the same and after verifying the genuineness of the receipt the petitioner shall be released.
