JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant by Rabe Alam and his family members. The petitioner is the sister-in-law (Bhabhi) of main accused Rabe Alam.

It is submitted by learned counsel for the petitioner that the petitioner has been roped in the present only because she happens to be the relative of main accused Rabe Alam and the victim has performed marriage with Rabe Alam and both are residing together.

Considering the thrust of accusation against Rabe Alam

Patna High Court Cr.Misc. No.53052 of 2015 (2) dt.23-11-2015 2/2 and the petitioner being a lady, it is a case for consideration of regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if she surrenders within a period of six weeks in connection with Gopalganj (Town) P.S. Case No. 197 of 2015 pending in the court of learned CJM, Gopalganj. Accordingly, the application is disposed of.
