2. In this case, the petitioner is seeking regular bail in connection with Bochaha P.S. Case No. 289 of 2023, registered for the offences punishable under Sections 279, 337, 338, 304(A) of the Indian Penal Code and added Sections 341, 323, 307 and 304/34 of the Indian Penal Code.

3. As per allegation, when the informant coming from the house of his sister with cash, a Tempo running rashly and negligently fled away after dashing his pulsar motorcycle and he and his brother became injured at the place of occurrence. During treatment, his brother, Rajnish Kumar died and the informant's treatment was going on at the time of lodging of the F.I.R.

4. The learned counsel for the petitioner has submitted that

No.66955 of 2024(2) dt.26-09-2024 2/2 from perusal of the F.I.R., it shows itself that it is a case of causing death by rash and negligent driving and it was not intention of the petitioner to kill the deceased. The petitioner is under custody since 06.06.2024 and he is a person of clean antecedent.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 14, Muzaffarpur (East) in connection with Bochaha P.S. Case No. 289 of 2023, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
