2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 310 (2) of the BNS.

3. The case of the prosecution is that five unknown miscreants booked tempo belonging to the informant and after some time tried to loot the same. In the meanwhile, the tempo met with an accident and was subsequently seized by the police. At the same time, one Pawan was also apprehended, who was actually accompanying the petitioner. However, he turned into a police witness and stated that the present petitioner was involved in the alleged looting of the tempo.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.62526 of 2025(3) dt.27-11-2025 2/2 petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that although the petitioner has given a confessional statement wherein he allegedly confessed his guilt, except for the said statement, no incriminating material has been recovered from him. No recovery whatsoever has been made from the possession of the petitioner except a mobile phone. Moreover, the petitioner is languishing in judicial custody since 28.06.2025 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Hulasganj P.S. Case No. 123 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad.
