Petitioners are apprehending their arrest in Kopa P.S. Case no. 16 of 2017 for the offences registered under Sections 341, 323 and 498-A/34 of the Indian Penal Code and 3 / 4 of the Dowry Prohibition Act.
It is alleged that petitioners are said to have tortured the informant due to non-fulfilment of additional demand of dowry.
It has been contended on behalf of the petitioners that they have got no criminal antecedent. They have falsely been implicated in the present case. There is no specific overt act
Patna High Court Cr.Misc. No.22525 of 2017 (2) dt.01-06-2017 2/2 against the petitioners. General and omnibus allegation is there against the petitioners. Petitioners are mother-in-law, father-in-law and unmarried sister-in-law of the informant. They have no concern with the family affairs with informant and her husband. Considering the facts and circumstances of the present case, let petitioners, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Saran at Chapra, in Kopa P.S. Case no. 16 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
